Film Submission Agreement
This Agreement is entered into between you (the “Submitter”) and the operator of newswedishcinema.se (the “Platform”, “we”, “us”) when you submit a film through the Site. By submitting a film and by ticking the confirmation box on the submission form, you agree to this Agreement.
1. What you are submitting
“Film” means the audiovisual work you submit through the Site, together with any still images, poster art, description, credits, and other materials you provide.
2. Your ownership
You keep all copyright, moral rights and other intellectual-property rights in your Film. Nothing in this Agreement transfers ownership to us.
3. Licence you grant us
You grant the Platform a non-exclusive, worldwide, royalty-free licence to: (a) stream the Film on the Site on the night we choose to feature it, and on further nights we curate (for example Film of the Month or Film of the Year replays); (b) use short clips, still frames, thumbnails, posters and a trailer of the Film to promote the Film and the Site — on the Site, in email, in social media, and in other marketing; (c) keep the Film available in the Site’s public archive after its featured night; (d) display your name, biography and other creator information you provide alongside the Film. This licence is non-exclusive: you may publish, screen, submit or licence the Film anywhere else, at any time, in parallel.
4. No exclusivity
We do not require exclusivity. You are free to enter the Film in festivals, distribute it on other platforms, and publish it publicly before, during or after we feature it.
5. No compensation
At present, submitting a film is free of charge and there is no fee, royalty or revenue share paid to the Submitter. The value exchanged is exposure, curation, and inclusion on the Platform. If we introduce paid features or revenue share in the future, they will be offered under a separate written agreement.
6. Your warranties
You warrant that: (a) you own, or have secured, all rights necessary to grant the licence in section 3 — including any rights of co-authors, performers, composers, and other contributors; (b) the Film and all materials you provide do not infringe copyright, trademark, publicity, privacy or any other right of any third party; (c) you have obtained all necessary releases (e.g. from actors, from music rights holders, from location owners), and can provide copies on reasonable request; (d) the Film complies with applicable Swedish and EU law and does not contain unlawful material.
7. Indemnity
You agree to indemnify and hold the Platform harmless from any third-party claim, loss, or reasonable legal cost arising from a breach of the warranties in section 6.
8. Take-down at your request
You may ask us to remove the Film from the Site at any time by writing to contact.newswedishcinema@gmail.com. We will remove active playback within 30 days of a valid request. Because we may have already used clips or stills in earlier marketing, we cannot always retract copies that were published before your request; we will not create new marketing material featuring the Film after removal.
9. Take-down at our discretion
We may decline to feature a Film, or remove a Film we have already featured, at our discretion — for example if we believe it infringes a third-party right, breaches these terms, or no longer fits the Site.
10. Term
The licence in section 3 lasts as long as we keep the Film available on the Site. It terminates when the Film is removed under section 8 or 9. The obligations in sections 6 and 7 survive termination.
11. Governing law
This Agreement is governed by Swedish law. Any dispute shall be settled by the general courts of Sweden, with Stockholm District Court (Stockholms tingsrätt) as the court of first instance.
